Two crashes, two impaired charges, same Sudbury driver in less than eight hours

Police report 38-year-old man arrested twice in less than eight hours for drinking and driving offences, assaulting an officer and driving while under suspension

Greater Sudbury Police Service reported that a city man has been charged twice for impaired driving offences within an eight hour period over two days. The same driver was also involved in two separate motor vehicle crashes, said a police news release.

Police said the first incident occurred Nov. 25 at around 4:45 p.m. where a vehicle rear-ended another vehicle waiting at a red light at the Lorne Street-Martindale Road intersection. 

From there the driver proceeded to drive around the stopped vehicle and crashed into the railroad crossing wigwags.

As police officers arrived on the scene, they reported seeing a person in the driver's seat with signs of being impaired.

"The driver was placed under arrest for dangerous operation and impaired operation and was transported to police headquarters," said the GSPS news release.

It was during the visit to the police station that the driver committed an assault on a police officer, GSPS alleges, just prior to blowing three times over the legal blood-alcohol limit of point-zero-eight per cent. Along with the impaired charge, the driver was also charged with assaulting a peace officer.

Police said the driver was released on a promise to appear for a court date in December. 

"The driver was also given notice of a 90-day driver’s licence suspension and the vehicle involved in the incident was impounded for seven days," said the release. 

After several hours had passed, GSPS officers were dispatched to another incident, this time a single-vehicle crash on Dominion Drive in Hanmer, at 12:15 a.m. on Nov. 26. A community member reported to police there was a vehicle in the ditch and the driver appeared to be stumbling around the vehicle.

As police arrived they located the driver, who was showing signs of impairment, said the release. Using a portable breath screening device, the driver registered a fail, said police.

The driver was arrested for impaired operation and was transported to police headquarters, for further testing.

It was there that the driver refused any further breath testing. Police said the suspect turned out to be the same individual from the previous day. He was charged additionally with failing to provide a breath sample and driving while under suspension. 

Police said the suspect was held in custody and appeared in bail court Nov. 26 to answer to the additional charges.
