Sexual assault charges dropped against Sault Police officer

An internal disciplinary hearing was scheduled for Jan. 6, but will not go ahead after Dubie stepped down from the department earlier this month

A disciplinary hearing against Sgt. Marc Dubie officer will not go ahead this week after the two criminal counts of sexual assault were dropped and the officer resigned from the department.

The two charges of sexual assault against Dubie were withdrawn on Friday in front of Ontario Court Justice Romuald Kwolek, with a peace bond put in place as part of the decision. A publication ban prevents certain details from being published, including the names of the alleged victims.

On Friday, SooToday reached out to Dubie for comment through his attorney Michael Lacy but did not receive a response.

Dubie, 56, was charged after an investigation by the Special Investigations Unit concluded there was sufficient evidence to proceed against him in relation to incidents involving two women on two different days in December of 2022.

"Effective January 1, 2025, Marc Dubie has resigned as a member of the Sault Ste. Marie Police Service. As a result, Police Services Act hearings related to the above member cannot proceed," said a post on the Sault Ste. Marie Police Service's website.

The department did not respond to a request for further comment.

A four-day criminal trial was scheduled to begin on Feb. 4, 2025, but will not proceed now that the charges have been dropped. Charges against a local police officer are considered a conflict matter for the local Crown Attorney's office, which required out-of-town Crown Jason Nichol to be assigned to the case.

As part of the peace bond, Dubie is prohibited from communicating directly or indirectly with the two alleged victims or any members of their immediate families, and from being within 50 meters of them or their residences or workplaces for a period of 24 months

Dubie is the second Sault Police officer who was facing a disciplinary hearing to leave the department in the past few weeks. Last month, Const. Craig Johnson lost a disciplinary appeal and was fired after he was found to have filed a fabricated traffic report against someone living in his neighbourhood.
