32-year-old charged with refusing to take a breathalyzer test after a collision

Officers read the accused multiple demands for a breath sample, but he refused to comply

On Saturday, Sault Ste. Marie Police officers charged a 32-year-old man with failure or refusal to comply with a demand for a breath sample.

At around 10:20 p.m., officers were patrolling Northern Avenue when they saw a collision between a car and a truck at the intersection of Great Northern Road and Northern Avenue. 

Upon speaking with the driver of the car, officers developed grounds to believe his ability to operate a motor vehicle was impaired by alcohol.

Officers read the accused multiple demands for a breath sample, but he refused to comply. He was arrested. No physical injuries were reported, police said in a news release. 

Peter Maclean is charged with:

  • Failure or Refusal to Comply with Demand
  • Turn – Not in Safety (under the Highway Traffic Act)

Maclean was released on an appearance notice and is scheduled to appear in court on Feb. 28.

None of the allegations have been tested in court and the accused is considered innocent unless proven guilty.
